Agency Booking Terms and Conditions
Except where otherwise specified, we, Poseidon Portfolio Limited (Company registered at 384 Linthorpe Road, Middlesbrough, TS5 6HA Registered in England and Wales) act only as an agent in respect of all bookings we take and/or make on your behalf.
We accept no liability in relation to any contract you enter into or for any accommodation or other services you purchase (“accommodation”) or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any accommodation.
For all accommodation, your contract will be with the supplier / principal of the accommodation in question (the Supplier/Principal’). When making your booking we will arrange for you to enter into a contract with the applicable Supplier/Principal of the accommodation. Your booking with us is subject to these Agency Terms and Conditions and the specific booking conditions of the relevant Supplier/Principal you contract with and you are advised to read both carefully prior to booking. The Supplier/Principal’s terms and conditions may limit and/or exclude the Supplier/Principal’s liability to you. Copies of applicable conditions are available on request from us.
By making a booking, you agree that you:
- have read these Agency Terms and Conditions and agree to be bound by these terms and conditions;
- are over 18 years of age and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services; and
- accept financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
- Booking and payment
When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party these booking conditions. In order to confirm your booking, a completed and signed booking form is required by the Supplier/Principal, along with a non-refundable 25% deposit (or full payment if booking within 8 weeks of departure). If you pay the full amount and the booking is cancelled the balance amount (not the 25% deposit) will be refunded by the Supplier/Principal only if the property is re-booked within the eight weeks.
Your booking is confirmed and a contract between you and the Supplier/Principal will exist when we send you confirmation on their behalf. We will only provide you with this confirmation, on behalf of the Supplier/Principal upon receipt of your duly completed booking form, together with cleared funds for the full amount of the deposit.
Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.
If you have paid a deposit, the Supplier/Principal will require you to the full balance no later than 8 weeks (i.e. on or before the 56th day) before departure. If full payment is not received by this date, we will notify the Supplier/Principal who may cancel your booking and charge the cancellation fees set out in their booking conditions.
Except where otherwise advised or stated in the booking conditions of the supplier concerned, all monies you pay to us for accommodation will be held by us on behalf of the Supplier/Principal concerned.
The applicable prices shall be as confirmed at the time a booking is requested and are calculated per week and in Sterling or Euros unless otherwise stated. We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. You must check the price of your chosen arrangements at the time of booking.
Unless detailed as payable locally or as otherwise confirmed to you in writing, the price includes gas, electricity, water, weekly linen charge plus any maid service as specified or any other extra services specified at the time of booking.
You are strongly recommended to take out personal travel insurance for all members of your party. Some Supplier/Principals require that you do so. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details on receipt and take them with you on holiday.
- Special requests
If you have any special requests (for example dietary requirements, cots or room location), please let us know at the time of booking. We will pass on all such requests to the Supplier/Principal, but we can’t guarantee that they will be met and we will have no liability to you if they are not.
- Changes and Cancellations by you
Any cancellation or amendment request must be sent to us in writing, by email, fax or post, and will take effect on the day we receive it. Proof of posting is not proof of receipt, therefore you are advised to also confirm all changes to our Customer Services Department by e-mail to email@example.com
Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that such requests will be met. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the Supplier/Principal of your accommodation. The Supplier/Principal may charge the cancellation or amendment charges shown in their booking conditions (which may be as much as 100% of the cost of the accommodation and will normally increase closer to the date of departure). If you cancel 8 weeks or more before departure you will lose your deposit. In addition you must pay us an administration fee of £25.00 per person for any amendments to bookings. You will be notified of the exact charges at the time of booking.
Please note: some Supplier/Principals do not allow changes and therefore full cancellation charges will apply in such circumstances.
- Changes and Cancellations by the Supplier/Principal
We will inform you as soon as reasonably possible if the Supplier/Principal needs to make a significant change to your confirmed accommodation or to cancel it. We will also liaise between you and the Supplier/Principal in relation to any alternative accommodation offered by the Supplier/Principal but we will have no further liability to you.
- Our Responsibility for your Booking
Your contract is with the Supplier/Principal and its booking conditions apply. As agent, we accept no responsibility for the actual provision of the accommodation. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for any information about the accommodation that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to the total amount of commission actual received by us in relation to your booking (or the appropriate proportion of this if not everyone on the booking is affected).
We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.
If you do have a claim or potential claim against us, we require you to notify us of the nature and extent of the claim as soon as possible, so that we are aware of the potential claim and, if considered appropriate, have the opportunity to take such steps as we consider necessary to mitigate any loss or damage that you might suffer as a result of it.
No Liability for indirect or consequential financial loss:
Where we are held liable to you for whatever reason, our liability shall only extend to direct losses suffered by you .
- Visa, passport and health requirements
Unless you tell us otherwise, we are entitled to assume that all members of your party are British citizens who hold or will hold full British passports valid for the entire duration of the arrangements you chose to purchase. Information on visa, passport and health requirements, where given and applicable, is so given on this basis. Requirements may change and you are therefore strongly recommended to check the up to date position with the supplier of the arrangements, Passport Office, appropriate embassy or consulate or your doctor as applicable in good time before departure.
Because the contract for your accommodation is between you and the Supplier/Principal, any queries or concerns should be addressed to them. If you have a problem whilst on holiday, this must be reported to the Supplier/Principal or their local manager within 24 hours. If you fail to follow this procedure there will be less opportunity for the Supplier/Principal to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.
If you wish to complain when you return home, write to the Supplier/Principal. You will see their name and contact details in any confirmation documents we send you.
If you wish to complain about any service we have provided to you (i.e. our booking service) then please contact us directly.
Please note that we do not offer an alternative dispute resolution service. However, the European Commission’s Online Dispute Resolution Platform is available at http://ec.europa.eu/odr.
- Law and Jurisdiction
These terms and conditions are governed by English law and the courts of England and Wales have exclusive jurisdiction.
- Accommodation Ratings and Standards
All ratings are as provided by the relevant Supplier/Principal. These are intended to give a guide to the services and facilities you should expect from your accommodation. Standards and ratings may vary between countries, as well as between Supplier/Principals. We cannot guarantee the accuracy of any ratings given.
- Documentation & Information
All descriptions and content on our website or otherwise issued by us is done so on behalf of the Supplier/Principal in question and are intended to present a general idea of the services provided by the Supplier/Principal in question. Not all details of the accommodation can be included on our website. All accommodation shown is subject to availability.
The accommodation is let for holiday purposes only and may not be used for any other purpose without the written consent of the Supplier/Principal. The number of any party shall not exceed the published capacity of the accommodation as stated on our website, on behalf of the Supplier/Principal, at the time of booking.
You accept that the decoration, furnishings and items provided with the accommodation may differ from that shown in any brochure or literature available at the time of booking, due to necessary or other changes at the discretion of the Supplier/Principal.
You must notify the Supplier/Principal as soon as possible after arrival if the accommodation is damaged in any way or, throughout your stay, if any other problems or damage occur(s), so that the Supplier/Principal may take appropriate step. You may also notify us and we can contact the Supplier/Principal on your behalf. Except for any damage notified to the Supplier/Principal and/or us upon arrival, all damage to the accommodation and any loss, which, in each case, is apparent from an inspection of the accommodation after your departure, will be your responsibility to make good at your cost and you agree to fully indemnify the supplier in this respect. Any serious damage or misuse in relation either to the accommodation or items provided may, at the Supplier/Principal’s discretion result in your occupation being brought to an end.
You must arrive after 4pm (or 5:30pm depending on the villa) on the date of your arrival (if you arrive much later than the arrival time please inform the Supplier/Principal/their local manager).
- Accuracy of Prices and Brochure details
Important note: the information and prices shown on this website may have changed by the time you come to book your accommodation. Although we make every effort to ensure the accuracy of the website information and prices at the time of publishing, regrettably errors do occasionally occur. You must therefore ensure you check the price and all other details of your chosen accommodation with us at the time of booking.
